These terms came into effect on April 11th,2018.

Introduction

Thank you for choosing Flooring Hut.Much in the way we want to make it easy for you to purchase great value flooring products,we also want to make these areas of our website easy to use and without any confusing jargon. 
 
By accessing any areas of flooringhut.co.uk the user acknowledges the notices,and agrees to the terms and conditions,set out below. Flooring Hut("Flooring Hut","Company","we","us","our")owns and operates the flooringhut.co.uk web site.When we receive an internet order you will always get an e-mail from Flooring Hut confirming your order placed on our website.
 
We try our best to process all the orders within a reasonable time frame and according to the delivery options of your choice.If however,goods cannot be mailed within a reasonable time we will e-mail you to advise you of this and,if there is to be a delay,determine if you wish to continue with the transaction or offer you the opportunity to cancel your order.

1.Flooring Hut&Customers

All orders for goods(the “Goods”)to be supplied by Flooring Hut or any of its subsidiary companies as the case may be(hereinafter referred to as the “Company”)are subject to these conditions of sale and the placing of an order by a buyer(“the Buyer”)will constitute acceptance of these conditions.

2.Modification of these conditions

These conditions may not be modified or varied unless Flooring HUT agrees in writing and Flooring HUT will not be deemed to accept any other conditions not waive any of these conditions by failing to object to provisions contained in any purchase order or other communications from the Buyer.No person has authority on behalf of the Company to vary any conditions except by a written variation signed by a director or the company secretary.

2.1.Flooring Hut only accept orders after the goods purchased online have been delivered.The processing of payment and acknowledgement of an online order DO NOT constitute a legally binding contract.

3.Validity of quotations

Quotations from the Company are stated to be open for such time as may be specified in each such quotation and provided it is not withdrawn by the Company in such period it remains capable of acceptance.No binding contract will be created by the acceptance by the Buyer of the Company’s quotation until notice of such acceptance has been given in a purchase order and has either been signed by the Company’s duly authorised representative or the Company has indicated to the Buyer orally or in writing its acceptance of such order.

4.How these conditions apply

If the Buyer places an order with the Company without requesting a quotation from the Company or before such quotation has been provided,all deliveries carried out in satisfaction of such order will be subject to these conditions.

5.New accounts

Buyers are requested to make purchases via our website.

6.Settlement terms

Unless otherwise agreed by the Company in writing,accounts are payable in full prior to delivery of the Goods taking place.If the Buyer has exceeded any agreed credit terms,the Company may demand immediate payment of all amounts outstanding from the Buyer to the Company on any account.The Company reserves the right to withdraw credit at any time and demand immediate payment of all monies outstanding.

7.Interest claimed for late payment

The Company,at its discretion,shall be entitled to exercise it's statutory right to claim interest under the Late Payment of Commercial Debts Regulations 2002, as modified or re-enacted from time to time. The Company may exercise this right, in addition to any other rights it may have in respect of Goods or non-payment.

8. Payment in instalments

Where the contract is to be or may be fulfilled in separate instalments, deliveries or parts, payment for each such instalment delivery or part will be made as if the same constituted a separate contract. Failure by the Buyer to pay for an instalment in accordance with this clause will entitle the Company without prejudice to it's other rights and remedies to suspend further deliveries of Goods under any other contract to the Buyer,pending payment by the Buyer.

9.Debt recovery

The Buyer will indemnify the Company against all cost,losses and liability including but not limited to all legal expenses and disbursements incurred by the Company in recovering any amount which is overdue from the Buyer to the Company pursuant of the Agreement or otherwise.

10.Prices

Unless otherwise agreed in writing all orders are executed subject to prices and any relevant discounts ruling at the date of receipt of the order and any price list of the Company whether published or not will not affect the right of the Company to charge for Goods in accordance with this clause.All prices are subject to the addition of Value Added Tax at the appropriate rate.Payment of the Price quoted and the VAT must be paid at sale,prior to delivery arrangements being made.

11.Our right to adjust rates&prices

In the event of termination,variation or suspension of a contract on the Buyer’s instruction or by lack of instruction,the contract price will be adjusted to reflect the additional costs incurred by the Company.Where a price per unit has been quoted and the Buyers requires a smaller number of units to be delivered than those quoted for,the Company reserves the right to adjust the rates of prices applicable thereto.

12.Credit

Any contract will be subject to the Company being satisfied as to the Buyer’s credit worthiness and without prejudice to the generality of the foregoing the Company may in its absolute discretion,having informed the Buyer that the Goods are ready for delivery,refrain from delivering the Goods until such time as the Buyer tenders the purchase money to the Company in a form satisfactory to the Company.

13.Delivery

Fast Delivery

We aim to deliver on your preferred date of delivery,however we cannot guarantee your chosen day or the speed of our deliveries,please allow 1-7 working days for your delivery.


Delivery Terms

A charge for delivery will be applied where the order value is less than the 'Free Delivery' threshold given below. If you change your mind,you can cancel your order up to 14 days after the day of delivery with the return of goods back to Flooring Hut at your expense,with no restocking fee.

*Free delivery is available where your order value is over £299 inc. VAT. Exceptions include the postcode delivery areas shown below and certain brands where there is a small order charge applied to the cost of delivery.

The following postcodes are only eligible for a 2-3-day service:AB,IV,PH,HS,ZE,KW,JE,GY,IM.

Please be aware that customers living outside of Mainland UK or in some territories of Scotland may not be eligible for next day delivery or AM service.Deliveries outside mainland UK may incur extra delivery charges.

Delivery Process

To keep you informed throughout the entire delivery process,when we receive your order you are sent an e-mail order confirmation,followed by a notification of dispatch when your order has left our warehouse.You may also get SMS updates if you have selected that option at checkout.


How your order is delivered

Deliveries are made 'kerbside'.Handling the goods is the responsibility of the recipient of the goods.When making a large order we advise to plan ahead and arrange a second pair of hands to help if you're receiving lots of boxes, especially if your order is for a room not on the ground floor.  Please note: This applies to flats, tower blocks, high rises etc.


Missing Items

If for any reason your order didn't arrived within 1-5 working days,please contact us straight away.If after a couple of days your order has still not reached you,we will investigate and,if necessary,send you some new items to replace the ones you haven't received.


Failed Deliveries

If your order arrives as arranged but we're unable to deliver because there's nobody home, there's inadequate help available,the goods are refused,or the order is cancelled whilst in transit(goods are in transit 24 hours before the chosen delivery date)you will be liable for any additional costs incurred for the goods being returned.


Northern Ireland

Unfortunately we are unable to deliver to locations in Northern Ireland.

We strongly advise against booking installers until goods have been received and checked as, regrettably, we cannot be held responsible for any consequential losses.

 

14.Our returns and Cancellation Policy

Here at Flooring Hut we pride ourselves in supplying top quality goods at great value.However,sometimes projects don't go to plan or we change our minds. Here's our jargon-free terms for Returns and Cancellations.

*We will be happy to issue your refund on receipt of goods in an unopened,unused and undamaged condition.See below:
 
Change of Mind(within 14 days)

If you change your mind,you can cancel your order up to 14 days after the day of delivery with the return of goods back to Flooring Hut at your expense,with no restocking fee.


Change of Mind(after 14 days)

After 14 days we can still refund or exchange your goods,but you will be charged a 30%re-stocking fee(restrictions apply).We are unable to accept returns outside of 30 days from the date the goods were received by the customer.


Commercial/B2B Sales on Flooring Hut (within 14 days& after 14 days)

Please Note:We regret that we must charge all non-faulty goods returned @ 25-45%re-stocking fee(depending on the product).We are charged this by our supplier(s)also and do not make any profit on this.This fee will be deducted on the safe return of the goods and from your order invoice total.The cost of the return is payable by the customer.This clause applies  to commercial&B2B sales at www.flooringhut.co.uk.


Cancellation fees

If a B2B customer cancels an order after it has been processed,we reserve the right to charge up to 10%of the total order value as a cancellation fee to cover administrative costs.


Faulty and/or Damaged Goods

If your order arrives with a manufacturing fault or damages,we ask you to report this within 5 days and we will make all the necessary arrangements to have the goods replaced without cost to you.PLEASE NOTE:We require photographic evidence that the damage has occurred in transit.Photo(s)of damage before the delivery packaging is removed please to:sales@flooringhut.co.uk.

How to return your purchase

  1. Please contact us via Email(sales@flooringhut.co.uk)or Phone to start the returns process.
  2. Our customer service team will supply you with a returns number.
  3. Please send the goods back to the Flooring Hut returns address:
    Flooring Hut Ltd,Unit 1,Downsbrook Trading Estate,Southdownview Way,Worthing BN14 8NQ.
  4. Once the goods have been received,we will start the process of refunding you using the details provided at purchase.

 

Your responsibilities when returning your order

  • You are responsible for arranging courier transport and for the safe return of goods(making sure they are well protected).
  • Costs for damaged goods will be taken from the total amount refunded.
  • Please remember,in all situations where there is no manufacturing fault,you are responsible for returning the goods to us,at your expense,in complete,unused,and in "as new" condition and within 30 days of purchase.

 

Products that cannot be returned

We cannot except returns for the following items:Accessories,Glue,Liquids,Screeds,Tools,Tubs,Bags and all LVT Design/Feature/Inlay Strips.


IMPORTANT NOTE:Carpet/Sheet Vinyl/Bespoke material orders:

If your order is considered a bespoke order(i.e.all roll products,Carpet/Sheet Vinyl/Bespoke material(s)cut to your specific order size/requirement)then we cannot accept a cancellation of contract or a return of the product.As the product was made/cut for you specifically,your statutory rights by law to cancel do not apply.All sheet vinyl and Marmoleum floors,cut to a specific size are non-returnable bespoke items.

Polyflor Expona Simplay.Note:This is a special order floor and is non-returnable.

 

Amtico Flooring

We cannot accept returns for all Amtico Signature floors as they are a bespoke product and made to order by Amtico.In addition,we cannot accept returns for Amtico Spacia and Amtico Form parquet/herringbone style floors as these are cut to order by Amtico.

When we have the right to decline your return request

In some circumstances we may refuse your return,with the following reason

  • Goods and Services worth £42.00 or less.

 

Failed Deliveries

If your order arrives as arranged but we're unable to deliver because there's nobody home,there's inadequate help available, the goods are refused, or the order is cancelled whilst in transit (goods are in transit 24 hours before the chosen delivery date) you will be liable for any additional costs incurred for the goods being returned.

15. Passing of Title/Risk

Risk of damage to or loss of the Goods will pass to the Buyer upon delivery.

16. Ownership of the Goods

Ownership of the Goods will not pass to the Buyer until the Company has received in full (in cash or cleared funds) all sums due to it in respect of the Goods and all other sums which are or which become due to the Company from the Buyer on any account.

17. Descriptive matter, Specifications & Illustrations

All descriptive and forwarding specifications, drawings and particulars of weights and dimensions issued by the Company are approximate only and intended only to present a general idea of the goods to which they refer and will not form part of the contract. All particulars are provided by the manufacturer.

18. Limitations of Liability

Nothing in these terms and conditions excludes or limits the liability of the Company for death or personal injury caused by the Company’s negligence or fraudulent misrepresentation, or the conditions as to title implied by section 12 of the Sale of Goods Act 1979 as amended from time to time.

19. Our Total liability

The Company’s total liability in contract tort (including negligence or breach of statutory duty) misrepresentation or otherwise, arising in connection with the performance of this contract will be limited to the price agreed for the Goods.

20. Legal Construction

Unless otherwise agreed by the Company in writing, these conditions will in all respects be construed and operate as an English contract, in conformity with English Law, and the parties submit to the exclusive jurisdiction of the English courts.

21. Force Majeure

The Company will not be liable to the Buyer in any matter or be deemed to be in breach of this contract because of any delay in performing or any failure to perform any of the Company’s obligations under this contract if the delay or failure was due to any cause beyond the Company’s reasonable control.

22. Clearance items & Special offers

Goods bought from promotional offers that are offered as clearance or end of line will be refundable at the sale price only. If the item is no longer stocked by the Company there will be no material replacement. Credit can be issued against a replacement product.
Flooring HUT will have no liability (other than imposed by the unfair contract terms act 1977), for any direct injury, loss or damage whatsoever, if the cause thereof lies beyond the reasonable control of the Company. Your statutory rights are not affected by the above exclusions.

23. Buy Now, Search Later Price Guarantee

If you find your Flooring Hut basket total cheaper elsewhere (from a genuine, recognised flooring competitor in the United Kingdom) within seven days of your purchase from Flooring Hut we will guarantee to refund the difference to you.
 
What you'll need to make a claim:

  1. The competitor’s name and store location/website address.
  2. Competitor quoted products must be able to be purchased online using an accepted payment method such as debit/credit card or PayPal.
  3. The final basket total as a written quotation on company branded letterhead/e-mail(a website screenshot is not sufficient evidence)from the Flooring Hut competitor detailing the relevant information and matching exactly the products contained in your Flooring Hut basket/purchase.(To qualify your submission to Flooring Hut must be within 7 days of your Flooring Hut invoice date).
    Please note:Failure to supply any of this information will result in a claim being delayed or denied.

 

Terms & Conditions Clause (Inspection Fees)

 

Product Inspection and Fault Claims

If a customer reports that goods are faulty, we may arrange for an inspection to assess the claim. This inspection may be carried out by an independent third-party specialist.

Where a genuine manufacturing fault is confirmed, we will cover all reasonable costs associated with the inspection, collection, and resolution in accordance with your statutory rights.

However, if the inspection finds that:

  • the product is not faulty, or
  • the issue has arisen due to wear and tear, incorrect installation, misuse, or lack of appropriate care,

we reserve the right to recover any reasonable costs incurred in arranging the inspection.

These costs will be clearly communicated to you in advance, and by agreeing to proceed with the inspection, you accept that such charges may apply if no fault is found.

This clause does not affect your statutory rights under applicable consumer law.
